This agreement is made on the 1st day of June 2017, between Great Wall Apartment Phase III Home Owners Association and Mr. Alexander Kitavi Kavivya
1. POSITION
We are pleased to inform you that Great Wall Apartment Phase III Home Owners Association has accepted to offer you employment contract as an Estate Accountant under the following terms and conditions
2. DURATION
This appointment will be effective from 1st June, 2017.
3. PROBATION
You will be on 3 (Three) month’s probation with effect from 1st June, 2017. While on probation, this contract can be terminated by either party giving 7 (seven) days notice in writing or by payment of 7 (seven) days salary in lieu of notice. The probation period may be extended for another period of three months to ascertain suitability for the position.
4. REPORTING
In this position, you will report to the board of management
5. JOB FUNCTION
The employee shall be employed as an Estate Supervisor and shall also be required to carry out related functions as the association may from time to time require. A Job Description is provided.
6. HOURS OF WORK
The standard hours of work are from (working hours) Monday to Friday from 8:00am to 5:00pm and Saturdays 8:00am to 3:00pm with one hour meal break each day. You may be required to work on different days and additional hours if your Job or business requirements make this necessary
7. PLACE OF WORK
For the time being your work station shall be the management office within the estate, Mlolongo. You may be required to work in any other location where the association may send you on duty.
8. REMUNERATION
For the duration of this contract, in this position, you will be paid a consolidated gross salary of Kshs. 42,000 per month paid in arrears at the end of the month. This will be subject to statutory deductions i.e. PAYE, NSSF, NHIF and other association deductions such as; staff purchases, charges for losses or damages, loan repayments, salary advances etc
9. LEAVE
After twelve months of continuous service, you will be entitled to 21 working days as fully paid annual leave. Except for emergencies, Leave shall only be taken at times approved by the association
10. TERMINATION OF SERVICE
In case you want to terminate employment, you will be required to give 1 (one) month notice in writing or pay 1 (one) month salary in lieu of notice
The association also reserves the right to terminate your services without any notice or salary in lieu thereof on grounds of gross misconduct or even in the case of reasonable suspicion of misconduct, disloyalty, theft, dishonesty, gross negligence, non-performance, indiscipline or if convicted by a court of Law and any conflict of interest
The association reserves the right to terminate your services without assigning any specific reason whatsoever for such termination by giving you 1 (one) month notice in writing or an equivalent of 1 (one)month salary in lieu thereof
You must return all association property and document in your possession
11. CONDITIONS OF EMPLOYMENT
Prior to commencing employment, you must provide the following documents;
Certified copy of your Kenyan ID or passport
If required, a certificate of good conduct, not more than one (1) month old
Copies of all certificates
Two passport sized recent photographs
A filled in emergency contact form obtainable from the Association’s office
Copies of NHIF, NSSF and PIN NUMBERS
12. CONFIDENTIALITY
The employee shall not disclose to any third party any confidential information obtained during the course of contractual employment unless expressly authorized by the Association.
Confidential information for the purposes of this contract includes and is not limited to resident’s information, estate secrets, business plans, strategies, financial and any other unauthorized information.
Employee’s obligation to maintain confidentiality and secrecy shall apply after employment until such time that the information is no longer confidential or has been made public by the estate management.
Employee shall not without prior written consent of the Association destroy, make copies, duplicate or reproduce in any form the Association’s confidential information
All other standard and general rules, practices and policies of the association as existing now which may be amended from time to time will be applicable to you and you will be expected to abide by the same
No employee is allowed to make press statement or represent the association in any meetings without prior authorization from the board of management or the approved persons.
14. GOVERNING LAW
This contract shall be governed by and construed in accordance with the laws of Kenya
Kindly sign the copy of this letter indicating your acceptance of the above terms and conditions of this appointment and return the same to the undersigned.
