BOOKING AGREEMENT
THIS BOOKING AGREEMENT is made at Karachi, on this 14th day of April 2023
BETWEEN
M/S Alcazar Builders & Developers at Office # 501 Floor 5th Midway Commercial B-86 Bahria Town Karachi, plot owners Asif Iqbal CNIC #- R/O 86/2 street # 21st Khayaban e Rahat DHA Karachi, Imran Khan CNIC #- R/O F 102, Allama Rasheed Road North Nazimabad Block F Karachi, hereinafter referred to as the “VENDER” (Which expression shall mean and include his heirs, legal representative, administrator, executor and assigns) of the ONE PART.
AND
Ms. Parveen Malik D/O Haji Yousaf holding CNIC #- resident at House No. S-7, Mohalla 18, Saff Lane, DHA Phase-II, Karachi South, hereinafter referred to as the “VENDEE” (Which expression shall mean and include his heirs, legal representative, administrator, executors and assigns) of the other part.
WHEREAS the VENDOR above named is at the date of signing of this agreement seized. Possessed of and is otherwise well and sufficiently entitled to all that Plot # 127 & 128,
Avenue 2, Prescient 2 (ARK-I) SITUATED AT BAHRIA TOWN, KARACHI, hereinafter referred to as the said PLOT.

And whereas the vendor has proposed to construct building on said plot, and it is agreed between the VENDOR and VENDEE that VENDOR has agreed to allot on booking to VENDEE Flat No. 602 on 6th Floor Measuring 850 Sq.ft. Approx. in the building proposed to be constructed on said plot for a lump sum price of furnished unit Rs. 12,500,000/ (Rupees Twelve Million Five Hundred Thousand Only), (if there is any increase or decrease in the above mentioned area then it would be calculated upon Rs.14,700/= Per Sq.Ft) free from all claims, charges. Burdens, disputes, liabilities, mortgage, encumbrances of whatsoever, on the following terms and conditions.
NOW THEREFORE THIS AGREEMENT WITNESSETH AS UNDER:-
1. That the vendor is receiving from the Vendee a sum of Rs. 12,500,000/ (Rupees Twelve Million Five Hundred Thousand Only) full and final payment through__________________
___________________________________________________. Being the payment towards sale consideration of the said property receipt of which the vendor both hereby fully admit and acknowledge.
2. That electricity and water charges shall also be paid by vendee at the time of Possession as and when demanded by the vendor.
3. That the vendor shall be liable to pay all taxes, liabilities in respect of the Said Property up to the date of offer letter of handing over vacant and physical possession of the said property to the vendee to the vendee from the date onwards the same shall be borne by the vendee alone.
4. That in case of dispute Vendee has only right on the Flat No. 602 on 6th floor (same unit) and he/she does not have any right on the other units of the said plot/building.
5. That the Vendor covenants with the Vendee that the said property is his/her separate, exclusive, individual and absolute property and that he/she has legal rights full power and lawful authority to transfer/Sell the same to the Vendee.
6. That the said property has not been mortgaged with any loan given agency/bank throughout Pakistan and also not under litigation in any court of law.
7. That the vendor hereby undertakes that he/she has not entered into any agreement or negotiation of Sale, Gift and Rent etc. of the said Flat/Shop prior to this agreement of sell.
8. That the vendee shall have the legal right and lawful authority to get the said Office /Flat /Shop transferred/conveyed in his/her own name or in the name of his/her nominee or nominees on full payment.

9. In case of change of policy from Federal Government, Sindh Government, Bahria Town Karachi, M.E.O., K-Electric, SSGC, City Government or from any other Higher Authority or any other unavoidable circumstances if construction work may delay, the builder will not be responsible for the same and if any authority imposes any new tax from date onwards it would be bone alone by the Vendee.
10. The CVT for C Lease(if any) (CVT for C’ Lease would be charged after dividing the whole amount of the paid challan on whole number of units in the said project and vendee would be liable to pay for his share) in addition to transfer/sub lease charges(if any),stamp duty(if any), Registration charges(if any),Documentation Charges (if any, CVT (if any) and any other New Taxes Government will impose as mentioned in clause (9) above.
11. After issuing offer letter for possession or Transfer of the said Unit by the vender the vendee would be liable to have its Possession or Transfer of the said unit with 30 days he would be liable to pay Rs.15000/= per month for Non occupancy/Maintenance charges.
12. That all the roof of the building will be property of the builder and if vendee wants to use it they can use it after written permission by the builder but builder can use the same without any permission for sign board or any other purpose and Vendee shall not raise any claim or objection on the same.
13. That it is agreed by the vendee to the vendor that after the possession of the said unit, whatever maintenance charges decided by Vendor or his nominee, the vendee would be liable to pay regularly in advance as and when demanded and a sum of Rs. 50,000/= (Rupees Fifty Thousand Only) would also be deposited beside the above agreed price as a security deposit for maintenance charges to the Vendor or his nominee. This would return after selling of said unit and after obtaining the same from the new Vendee of the same unit.
14. In case of said unit is sold, the contract shall be made directly with the new purchaser and all further dealing includes payment shall be directly arranging between builder and new purchaser, all the payment made by the first party already to the builder shall be reimbursed including profit and token money.
