Subject: Legal Demand Notice
Sir,
I, on behalf and under instructions of my clients Mr. Deepak and Ms. Poonam , R/o G-33, 2nd floor, Lajpat Nagar, New Delhi serve upon you the following legal notice:
1. That my clients had purchased one Sony BRAVIA TV; Model No. KLV-32W400A, serial no- and was being used for a period of 7 years and thereafter a defect arose.
2. That immediately thereafter my clients contacted your authorized service centre Club Electronics, Sony Authorized Service Centre, E-25, South Extn. Part II mkt, New Delhi-110049 to register their complaint and requested repairs of the defective product, on which your authorized service centre sent an authorized service personnel.
3. That thereafter the service personnel checked the defective product and told the estimated cost of Rs.1,500 for the repair and subsequently, the TV set was taken away by the authorized personnel as the required part or equipment needed for the repairment was not available with the authorized service personnel and my clients was assured by the service personnel that the Television will be repaired and returned to him in few days, and in return my clients were provided a service job sheet numbered as J- dated 15/09/17.
4. That my clients tried to reach your authorized service centre repeatedly for the status of the Television, the authorized service centre conveyed that they were not able to procure the defective part and demanded some more time for the repairing purpose and the time kept elapsing for over 4 months.
5. That thereafter my clients visited your authorized service centre in person and it came to the knowledge of my clients that the addressed authorized service centre had been permanently shut down.
6. The same was communicated telephonically to Ms. Anjali (Regional customer support, Sony India Pvt. Ltd.), a replacement for the defective TV was offered to my clients, and then afterwards on E-mail dated 24/12/2018, another offer was made as a new BRAVIA TV; Model No. KD-55X70025 at a special price of Rs.77,940/- as compensation for the defective TV, therefore the offer made on mail was completely inconsistent to the offer made to my clients telephonically.
7. That my clients has been suffering continued harassment and annoyance due to the fact that your authorized service centre have falsely conveyed to repair defect which cannot be repaired, coupled with the fact that you as the manufacturer of the above product are avoiding any after-sales responsibility, thereby inducing a feeling in my clients that they has been cheated by you and your authorized service centre.
Through this notice, you are hereby called upon to compensate the above defective product or to pay to my clients, a sum of Rs. 38,000/- (Rs. Thirty Eight Thousand Only), i.e., the cost of the above noted product at which my clients purchased the same.
You are further called upon to pay towards my clients a sum of Rs. 25,000/- (Rs. Twenty Five Thousand Only) in compensation to the mental agony and harassment suffered by my clients at your hands, given the above defective product.
That you shall also bear Rs. 21,000/- (Rs. Twenty One Thousand Only), towards the cost of this notice and the same shall be deposited along with your above mentioned liability.
A copy of this notice is being retained at my office for further action.
