(Under Section 73 of The Children Act Cap 59 as amended, rule 19 (1)2(j) and (3) of the
Children (Family and Children court rules) S.I 59 -2)
I …………………..being the biological mother of ………….. apply for a custody order against
…………………. being the biological father of …………….. on the following grounds:
1. THAT I am the biological mother of ………………….
2. That the respondent is a married man and does not want to associate my child with his other
family
3. That the respondent took Applicant’s child to live with his parents at …………………in a
two bedroom house with other three relatives of the respondent.
4. That the home is not conducive to the welfare of the children as it is shared by many people
hence lack of privacy
5. That the child can’t fully express herself since she is surrounded by adults
6. That the child lacks proper discipline as she receives no guidance and cannot freely access
the maternal side of the family
7. That the Applicant, ………………. has been denied access to her child by the respondent
8. That the respondent doesn’t have time for the child since he is fully covered by his
matrimonial family.
9. The respondent stopped supporting and looking after the child for the first one year after
the birth of the child on 12th December 2010
10. That the respondent has better income than the applicant and can ably cater for the upkeep
and welfare of the child
11. That the Applicant can meet all the psychological, emotional and social needs of the child
and has a two room house where she can stay with the child and also earns some income
from selling second hand clothes which can supplement the welfare of the child
12. That the nature of nurturing children is on their mothers and she is fit and proper person to
take care of the child
13. That it is in the best interest of the child that the Applicant believes granted Custody.

AFFIDAVIT IN SUPPORT OF THE APPLICATION
I ……………………. C/o M/s ……… & CO. Advocates P.O.BOX……, Kampala do swear and
make an Oath as follows,
1. That I am a female adult Ugandan of sound mind and the applicant in which capacity I
swear this affidavit
2. That I am the biological mother of ………….of 8 yrs Old (Birth Certificate herein
annexed and marked “A”)
3. That on about 1st, January 2019 the respondent took away the child from me to go and live
with his parents at Mattugga
4. That the home is not conducive to the welfare of the children as it is shared by many people
hence lack of privacy
5. That the child can’t fully express herself since she is surrounded by adults
6. That the child lacks proper discipline as she receives no guidance and cannot freely access
the maternal side of the family
