NO. __________ PETITION FOR ADMINISTRATIVE RECONSTITUTION OF TRANSFER CERTIFICATE OF TITLE COMES NOW, petitioner Al-Rafih Alvarez Azis through counsel, unto this honorable Court, respectfully alleges: 1. That petitioner is of legal age, married, Filipino citizen and residing at Terryhills Subdivision, Bulua, Cagayan de Oro City; that the respondent is the Registry of Deeds of the Province of Sultan Kudarat; 2. The petitioner is the owner, by virtue of a notarized Deed of Absolute Sale dated June 20, 2016, of a parcel of land, Lot 597-O of the Subdivision Plan (LRC) Psd-184332 being a portion of Lots 597, buluan pls-73 (LRC), covered by Transfer Certificate of Title No. T-35208, containing an area of 702 square meters, located in New Isabela, City of Tacurong, Sultan Kudarat; 3. That petitioner submitted to the Registry of Deeds of Sultan Kudarat in Isulan, Sultan Kudarat for the transfer and issuance of Transfer Certificate of Title in his name the following pertinent documents: a. The above-mentioned notarized Deed of Absolute Sale duly stamped mark with proof of payments of Capital Gains Tax, Documentary Stamp Tax dated June 29, 2016 and Transfer Tax Fee dated August 16, 2016; b. Certificate Authorizing Registration (CAR) dated July 21, 2016 issued by the Bureau of Internal Revenue in Tacurong City with attachments, ; c. Original Owner’s Duplicate copy of the Transfer Certificate of Title No. T-35208 in the name of Yasser O. Azis; d. Original Declaration of Real Property in the name of the seller Yasser O. Azis; 4. That on August 29, 2016, the old Sultan Kudarat provincial capitol was gutted in fire and the whole office of Registry of Deeds of the Province of Sultan Kudarat was burnt to the ground including the aforementioned documents; 5. That submitted herewith are the following documents in support of the instant petition: a. Certified true copy of the original Deed of Absolute Sale duly stamped mark with proof of payments of Capital Gains Tax, Documentary Stamp Tax dated June 29, 2016 and Transfer Tax Fee dated August 16, 2016; b. Certified true copy of the Certificate Authorizing Registration (CAR) dated July 21, 2016 issued by the Bureau of Internal Revenue in Tacurong City with attachments, ; c. Certified true copy of the Owner’s Duplicate copy of the Transfer Certificate of Title No. T-35208 in the name of Yasser O. Azis; d. Certified true copy of the Declaration of Real Property in the name of the seller Yasser O. Azis. 6. That the said Transfer Certificate of Title was never mortgaged or sold to anyone. PRAYER WHEREFORE, it is respectfully prayed that the Transfer Certificate of Title No. T-35208 lost and destroyed in the files of the said Registry of Deeds be ordered reconstituted on the basis of the owner’s duplicate transfer certificate of title in accordance with Republic Act No. 6732 and thereafter, a new Transfer Certificate of Title be issued in the name of the petitioner on the basis of the above-mentioned deed of absolute sale and proof of payments of capital gains tax, documentary stamp tax and transfer tax fees.
