AFFIDAVIT-COMPLAINT I, Mimbalawag Barabadan y Sarip, of legal age, married and a resident of Zone 3, Barangay Sugbongcogon, Tagoloan, Misamis Oriental, after having been duly sworn to in accordance with law, hereby depose and say that: 1. I am married to Irish Barabadan y Mayunado who converted to Islam on the day of our marriage. We got married last December 18, 2004 at Manticao, Misamis Oriental, under Muslim rites, customs and traditions, as evidenced by a Certificate of Marriage dated July 29, 2009 issued by the then Office on Muslim Affairs now National Commission on Muslim Filipinos (NCMF) attached as Annex A; 2. Because of my love and affection to Irish, I did not contract another marriage even if I am allowed to do so under our religion; 3. We were blessed with six (6) children, who are all minors, namely: Naisah Mayunado Barabadan, 15 years old (date of birth: December 10, 2005); Abdullah Mayunado Barabadan, 11 years old (date of birth: July 10, 2009); Abdellah Mayunado Barabadan, 10 years old (date of birth: March 8, 2010); Abdani Mayunado Barabadan, 9 years old (date of birth: March 8, 2012); Nizreen Mayunado Barabadan, 5 years old (date of birth: March 7, 2015); and Norhayati Mayunado Barabadan, 3 years old (date of birth: April 23, 2017). Copies of Birth Certificates of our children are attached as Annex B-1 to B-6; 4. Last July 23, 2018, our office, the Bureau of Customs conducted reorganization and I was assigned at the Bureau of Customs, Port of Subic, Subic Bay Freeport Zone, Zambales Province. Consequently, I relocated and reported for work at my new place of assignment. I left my wife Irish and my children at our home in Barangay Sugbongcogon, Tagoloan, Misamis Oriental. Since then, I constantly monitor them through cellphone call and video call on a daily basis; 5. Last month December 2020, I noticed that she seldom answers my cellphone call and video call. She would reason out that she was busy or that her cellphone was empty battery; 6. On December 27, 2020, my eldest daughter Naisah Mayunado Barabadan informed me that her mother Irish is having an illegal sexual intercourse/relationship with another man named Eric Cultura, who is a security guard of Phividec Industrial Authority located at MCT Complex, Tagoloan, Misamis Oriental; 7. At the same time, my daughter Naisah sent to me copies of pictures of Irish and her paramour Eric Cultura in intimate actions and positions, which are herein attached as Annex C; 8. My daughter also sent to me screenshots of the conversation through facebook messenger between Irish and Eric Cultura expressing their sexual desires toward each other, their endearments and their plan to elope to Camiguin; 9. Upon receiving and reading the photos and the conversation, I cried so hard because of the pain brought about by the traitorous acts of Irish in engaging in illegal sexual act with another man while we are very much married. I also hurt for my daughters who look up to Irish as their mother and for our very young sons. It pained me to think that while I am working in a very far place, sacrificing for the sake of giving a good life to Irish and to our very young children, Irish is busy with another man Eric Cultura and she is even planning to elope with him and to leave our very young children. Photos of Irish and Eric Cultura are attached as Annex D; 10. That I contacted Irish and she admitted to me that she indeed had committed illegal sexual intercourse/relationship with Eric Cultura. Thereafter, she left our conjugal house and went to her hometown Manticao, Misamis Oriental on December 31, 2020 at 5:00 o’clock in the afternoon. On January 1, 2021, at around 10:00 o’clock in the evening, she returned to our conjugal house in Barangay Sugbongcogon, Tagoloan, Misamis Oriental, collected her personal belongings and left again without notice. 11. That I went home on January 5, 2021 and went directly to the Tagoloan Municipal Police Station and reported the incident of Adultery and a caused that it be entered into a police blotter. A copy of the Extract from the Police Blotter No- is attached as Annex E; 12. I am executing this Affidavit to support my complaint for Adultery against my wife Irish Mayunado Barabadan and Eric Cultura; I am executing this affidavit to attest the truthfulness of the foregoing facts and to support the filing of Criminal Case of Adultery against Irish Mayunado Barabadan and Eric Cultura.
