TEMPORARY EMPLOYMENT CONTRACT

KNOW ALL MEN BY THESE PRESENTS:
This Contract is made and entered into by and between:
FRANCHISEE COMPANY , a single proprietorship/ partnership/corporation, duly
organized and existing under the laws of the Philippines and a Franchisee of BN
WHITENING SHOPPE with office address at Door 1&2 2nd Floor Boulevard Artiaga
Street, Davao City represented by BIANCA NARANJO Operations Manager and
hereafter referred to as The Employer;
- and CYNTHIA SONSONA of TRADING BOULEVARD, DAVAO CITY, PHILIPPINES
hereinafter referred to as Employee;
WITNESSETH: THAT
WHEREAS, the Employer is the owner of a franchised outlet known as BN
WHITENING SHOPPE has a requirement for CYNTHIA SONSONA work as SERVICES
ATTENDANT, with job description and qualification requirements.
WHEREAS, the Employee has presented himself / herself to be capable, qualified
and competent in performing the described task and desires to be considered for the
Position of SERVICES ATTENDANT under the terms and conditions of this Contract.
NOW THEREFORE, for and in consideration of the foregoing premise, the parties
as follows to wit:
1. TERMS OF ENGAGEMENT
This engagement is for BN WHITENING SHOPPE, a store located at Door 1&2 2nd Floor
Boulevard Center Building Artiaga Street, Davao City and for the specific duties, task
stated , and limited to the terms of this Contract as shown below:
2. COMPENSATION
a) Salary and Wages
For services rendered and the conditions set, the Employee or Beauty Consultant
shall be paid the following:
1. Minimum Wage according to the Philippine law, for a total of 8 hours work
2. A no work no pay policy shall be applied to this Contract.
b) Fringe Benefits
In addition to Salary and Wages the following shall be provided:
1. Food Allowance of P20 per day on the condition that the Employee or Beauty
Consultant would have rendered a total of 8 hour-work per day. Allowance shall not
be given should the employee/Beauty Consultant render less than 8 hours work
per day
2. Other regular fringe benefits as provided by the Philippine Laws such as:
13th Month Pay, SSS, Pag-ibig and Philhealth, Insurance
3. Vacation Leave and Sick Leave
A total of five (5) days paid leave shall be provided for vacation leave and sick leave.
Request for leave shall be used only for the purpose stated above. Leave credit are
not convertible to cash. Leave can be accumulated up to a period of two years.
3. EFFECTIVE DATE
This contract shall commence on ______________ until_____________ unless
pre-terminated for any reason under clause 4 below.
4. AMENDMENT
This Contract may be amended when deemed necessary upon the approval of the parties
5. PRE-TERMINATION
5.1. By the Employer
The Employer may cancel, pre-terminate or rescind this Contract for any of the
following grounds:

Failure or Employee to perform competently and efficiently his/her functions to the
position for which he/she was Contracted;
Willful breach by the Employee of the truth reposed on him/her by the Employer
Commission by the Employee of infraction(s) on rules, regulations or practices of
the Employer warranting his/her dismissal as well as the existence of any of the
grounds for dismissal under the Labor Code of the Philippines justifying
termination of the Contract;
By the Employee
In case the Employee intends to pre-terminate this Contract, he/she shall be give
written notice of this fact to the Employer at least one (1) month or thirty (30) days
before the effectivity of his/her resignation.
6. DIRECTION AND SUPERVISION
The employee shall report to his/her Supervisor and the Employer or his/her
representative/s in the execution of this Contract.
7. GENERAL UNDERSTANDING
It is understood that in the conduct of all these duties and responsibilities, the Employee is
expected to be guided by the principle of teamwork, cooperation, reliability, initiative,
diligence, trust, and cleanliness, good-grooming and environmentally-sound practices. It is
also understood that the Employee is expected to render other services that the General
Manager (or his/her representative) may require in any particular situation that may arise.
The Employee shall observe and abide by all rules and policies set forth in the
administrative manual and similar as may be applied under the term of this engagement.
8. CONFIDENTIALITY
Realizing the stiff competition prevailing in the retail industry, the Employee unqualifiedly
agrees to maintain in extreme confidence the following articles that may be obtained by
reason of this contract engagement.
1. Cart transaction, sales, business requirements
2. Contracts, documents, papers, deeds, receipts, records, reports, manuals and
similar
3. Instruments and devices, mechanisms and other tools or implements
4. Formulas, systems and methodologies
5. Blueprints, drawings, charts, maps and sketches
6. Other dealings and inquiries, including but not limited to the Business
conceptualization, formulation, fabrication, composition, development, processing,
packaging, merchandising, marketing and promotions, installation and repair,
delivery, shipment, storage, suppliers, products and similar.
The Employee hereby acknowledges his/her concomitant obligation to protect and not to
publish, disclose, share or otherwise reveal to any third party or his agent or sub-agent,
franchisees, or business partners or representatives, the abovementioned articles or any
and all information that may have been obtained by reason of this Contract, or negotiations
or discussions without the prior written consent/approval of the Employer.
9. APPROPRIATE LAW
This Contract shall be governed by and construed in accordance to the laws enforce in the
Philippines.
